There are two things which happened. One is that there was bifurcation
and second is union territory
Union territory means that the home ministry stays with the centre.
Law and order stays with the centre. And all
laws made are subject to the centre through the Governor.
This effectively means that now even if Mehbooba and Omar
come together they cannot change laws or
have a day on delimitation or also on issues relating to law and order. The
assembly is just for education, finance management, electricity etc. A big
move. Even delimitation can be done by the centre.
Second Ladakh becoming without legislature effectively means
it is totally in control of the centre and
60% of the land where the dispute was sought to be raised is cleared.
Third, they have in the notification not stated anything but
issued it under 370 (3) of the constitution
that all laws of the land will apply to the union territory which means all state acts are scrapped in one go to the
extent contrary to central laws. With
union territory the elected have hardly any
power.
Fourth this effectively also means that now the police is to
be deployed by Centre and not the territory.
When the police is with centre there can be deployment
of non-Kashmiris and hence militants cannot manipulate and get the support of police.
No terror rises without locals. Locals can be handled by
police deployed by Centre and police is not
sympathiser or informer to the terror organisation.
This means that the pipeline of finance is cut and people
like Mehbooba cannot give pardon or
cannot release stone-throwers.
Read this with an amended NIA act which makes centre capable of
picking up and punishing Hurriyat
leaders to any person who supports the terrorist organisations directly or indirectly.
This means that the freedom Which they openly said and
supported Wani or even Afzal Guru will
come to end and even in JNU students won't act against the government in manner and fashion done in past.
Smart move with an amendment in NIA and instant action on
Kashmir. No one thought of 370 (3) and read it with the provision which is
related to 370 (2) and not 370 (3), of the constitution.
